The Commission has decided to investigate/inquire into the matter in pursuance of the power conferred upon it under Article 338A of the Constitution of India, mentioned in the notice. The Commission said that it may exercise the powers of Civil Courts conferred on it under the Article 338 A of the Constitution of India and issue summons for the appearance in person or by a representative before the Commission upon not getting any response from the DGP in stipulated time. It is noteworthy that Dr. Giridhar Gamang had resigned from Congress party and joined BJP in June 2015.
